Savvyprofit Acceptable use Policy
IMPORTANT NOTICE PLEASE READ THESE TERMS CAREFULLY. THESE TERMS CONTAIN IMPORTANT PROVISIONS INCLUDING DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, ARBITRATION REQUIREMENTS, CLASS ACTION WAIVERS, JURY TRIAL WAIVERS, AND OTHER PROVISIONS THAT AFFECT LEGAL RIGHTS. BY ACCESSING, USING, REGISTERING FOR, PURCHASING, SUBSCRIBING TO, OR OTHERWISE USING THE SERVICES, CUSTOMER AGREES TO BE BOUND BY THESE TERMS.
1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") govern access to and use of the Services provided by SavvyProfit LLC ("SavvyProfit," "Company," "we," "us," or "our"). By accessing or using the Services, Customer acknowledges and agrees that: 1. Customer has read these Terms; 2. Customer understands these Terms; 3. Customer agrees to be bound by these Terms; 4. Customer has authority to enter into these Terms; 5. Customer will comply with all applicable laws. If Customer does not agree to these Terms, Customer must not access or use the Services.
2. ELIGIBILITY
Customer represents and warrants that: 1. Customer is at least eighteen (18) years old or the age of majority required under applicable law; 2. Customer possesses legal authority to enter into these Terms; 3. Customer is authorized to bind any entity on whose behalf Customer uses the Services; 4. Customer will provide accurate registration information; 5. Customer will maintain accurate account information.
3. SERVICES
SavvyProfit provides a cloud-based Contractor Operations ERP platform. The Services may include functionality relating to: - Project operations - Workforce operations - Customer records - Supplier records - Subcontractor records - Compliance records - Financial document records - Project folders - Mobile field operations - Communications - Workflow automation - Alerts and notifications - Search functionality - Artificial intelligence functionality - OCR functionality - Parsing functionality - Translation functionality - Reporting functionality - Forecasting functionality - Integrations - Other related services The Services are intended solely as business software tools. The Services are not intended to replace human judgment, professional advice, legal review, accounting review, payroll review, compliance review, engineering review, project management review, safety review, or regulatory review.
4. MODIFICATION OF SERVICES
SavvyProfit may at any time and without prior notice: - Add features - Modify features - Restrict features - Suspend features - Replace features - Remove features - Discontinue features Customer acknowledges that no feature, function, workflow, module, integration, report, dashboard, search result, automation, alert, or communication capability is guaranteed to remain available.
5. ACCOUNTS
Customer is responsible for: - Account administration - User administration - Password management - Credential security - Device security - Access control - Permission control Customer shall promptly notify SavvyProfit of any suspected unauthorized access. SavvyProfit may suspend or terminate accounts where reasonably necessary to protect the Services, Customers, Users, infrastructure, or third parties.
6. CUSTOMER RESPONSIBILITIES
CUSTOMER IS SOLELY RESPONSIBLE FOR: - Business decisions - Project decisions - Workforce decisions - Employment decisions - Payroll decisions - Compliance decisions - Safety decisions - Procurement decisions - Purchasing decisions - Contract decisions - Financial decisions - Regulatory decisions SavvyProfit provides software tools only. SavvyProfit does not make decisions on behalf of Customer.
7. CUSTOMER DATA
Customer retains ownership of Customer Data. Customer grants SavvyProfit a non-exclusive right to: - Host - Store - Process - Display - Index - Search - Organize - Classify - Back up - Transmit Customer Data solely for purposes of operating and providing the Services. Customer represents and warrants that Customer possesses all rights, permissions, authorizations, and legal bases necessary to upload and process Customer Data.
8. USER CONTENT
Customer remains solely responsible for: - Uploaded documents - Uploaded files - Images - Videos - Communications - Workforce records - Project records - Compliance records - Financial records - Contracts - Training materials - Customer-generated content SavvyProfit does not independently verify: - Accuracy - Completeness - Legality - Ownership - Authenticity of Customer Data.
9. COMMUNICATIONS
The Services may provide: - Chat - Group communications - Project communications - Internal communications - External communications - Notifications - Alerts - Messages - Voice-to-text functionality - Translation functionality Customer acknowledges that communications may contain: - Errors - Delays - Omissions - Translation inaccuracies - Transcription inaccuracies - Misinterpretations SavvyProfit does not guarantee communication accuracy. Customer remains solely responsible for reviewing and verifying communications.
10. AI, OCR, PARSING, SEARCH, TRANSLATION, AND AUTOMATION
The Services may utilize: - Artificial intelligence - Search systems - OCR systems - Parsing systems - Classification systems - Translation systems - Automation systems - Forecasting systems Customer acknowledges that outputs may contain: - Errors - Omissions - Inaccuracies - Hallucinations - Misclassifications - Incorrect recommendations - Incomplete information - Delayed information ALL OUTPUTS REQUIRE INDEPENDENT HUMAN REVIEW. CUSTOMER SHALL NOT RELY SOLELY UPON: - AI outputs - OCR outputs - Parsing outputs - Search results - Classifications - Recommendations - Alerts - Notifications - Forecasts - Reports - Communications for business, legal, compliance, safety, employment, payroll, procurement, financial, project, or regulatory decisions.
